Tuesday this week October 5th JetGroove the biggest on-line underground music provider has launched its website. On the website it offers alternative music downloads in mp3 format made by independent record labels and artists.
During first three days JetGroove received an enormous amount of attention from users, record labels, artists, authors and publishers. And this attention brought some contradictions to the light of music community. The music community was disappointed at some parts of our website and made some wrong assumptions. We wanted to clear up all misunderstandings that arose so we want to explain our position how our website is organized and business is led.
JetGroove is the unique project that we created to give the worldwide exposure to independent record labels and artists, producing alternative music. The way our website organized is:
First part of the website - music, that is represented by record labels who already signed contracts with JetGroove. These tracks are available to be purchased and downloaded.
Second part of the website - information about music that is placed on the website for promotion of independent record labels and artists. These "tracks" could not be purchased or downloaded. However they could be put ON HOLD. As soon as this happens, record label or artist to whom this track belongs is contacted with the offer of doing business with JetGroove. This greatly increases the exposure for many of the record labels.
The line that JetGroove is going to continue to follow is: LEGAL SALES ONLY. The project was created to give independents a good chance of being known in the world, and earning money, not to make them suffer again as they do from p2p systems. And the least thing JetGroove planned to do is to violate rights of record labels, publishers, artists or authors. JetGroove officially states that if you are not interested to have your tracks on http://www.jetgroove.com, you should contact JetGroove immediately and all the information we have about your tracks will be taken off the website ASAP.

Well, you are right in a way. The thing is that we are talking about two completly different licensing issues here.
First performance/broadcast rights.
If the label is registered with the royalty organisation, all that is needed is that you paid your fees to the royalty organisation that deals with performance royalties.
Secondly reproduction/distribution royalties.
This area I don't know much about, but I presume you would really need a permission from either label or distributor to sell tracks on a website.
As I can see it jetgroove can't be breaching any of this laws, provided they paid broadcastibng fees. It's a grey zone in between the different set of laws.
There is one thing though.
Since many labels in this scene actually is not registered with the royalty organisation, the terms they printed on the CD with regards to broadcasting/performance is the ones in effect.
That would usally be the "unauthorized public performance/broadcasting"...etc.
That means that in that case they actually require a permission directly from the label to be allowed to have even the previews there.
Of course that also means that all broadcasts or sites like the various psy streams or psyshop is breaking the law in effect!

Seems as though they've removed everything.
I just tried searching for stuff from our label, Soular Records - which was listed yesterday. Its not there anymore. |

I am under the impression that they removed the whole "psychedelic" subcategory. It seems someone wrote a legal letter with a lot of influence.
not a single psychedelic track can be found using their search engine.

I know very well that legal action isn't allways easy, especially with internet-related problems and international problems...
But I still do very much doubt the way these gentlemen do busines... Lets jus say that they're not crooks (which I sincerely doubt btw)... then they have an awkward way of doing things. They say the're just placing samples of everyones work to find out what their market is, and what their buyers want. By doing this they're not only giving false hope to the chap who actually wants to buy something from them, but they're turning every label against them as we see now... Truth is, whether or not they are to be trusted, by the time they decided to start partnerships with labels, the labels won't want to anymore...

Hmmm... just checked the site again... it would seem that indeed all psy has been taken off, but most other music as well
