Using Unreleased tracks in DJ mixes

I usually play a lot of unreleased tracks that I get directly from artists in my DJ sets. I'm about to record a new DJ mix for promotional purposes - to give away at parties and perhaps stream online. All the tracks are going to be mixed in, 2 minutes at each end usually. Is it okay for me to use these unreleased tracks for the mix? Should I get permission from the artist, or should I try to use only released tracks and mass-distributed promos?

I've had unreleased tracks in my earlier mixes, but I only shared those with select individuals and party promoters. This one I intend to share with a wider audience. So I'm curious what the prevailing opinion is on this one.

well, I just wanted to see a wider range of opinions on this.

I never really thought about it, always seemed pretty harmless to me (since the tracks are so mixed in, they'd be impossible to rip out/steal). But recently a friend of mine recorded a set with some unreleased tracks in it - without giving it a second thought - and got in trouble with a label that had signed some of the tracks he'd used.

so just some opinions, to see how the artists/labels feel about this. On one side it's extra promotion, on the other side I guess they're paranoid, seeing how much ripping/stealing is going on out there.

but I'll definitely contact the artists for the set I'm doing.

Well.. it depends on a few factors... For one thing, if the track you want to play has already been given to a label to be released, I wouldn't suggest putting it on there unless it's a label that doesn't really mind. Also I highly doubt anyone is going to sit up and cut up your dj mix and assign the track names and put them up on SoulSeek. Now if you play the full track without it being mixed then that might raise a red flag for labels. I know that some labels have people that search the P2Ps to make sure that the trax they've signed aren't already out on the net. As lame as this sounds, if you are going to do the mix and put it online, put a version that isn't cut into the individual trax.           An Eagle may soar, but Weasels don't get sucked into jet engines.

I agree 100%, get either the artist's permission or the label's. At least that way your ass is covered. LoL
That's what I do anyway. Only a few times the artist says "no", and I respect that.

I agree with Mubali here, but I also think that a DJ-mix for promotional use is to show style and mixing technique. Therefor I would suggest that you put up some released material that keeps the same style as the one you usually play when you are using unreleased tracks in your mix, if you don't get the artists/labels permission to put their tracks in the mix. I know as Mubali states that it seems far-fetched that anyone would cut it up and put it online, but if it is a promotional mix this (from my perspective) would show that you got the technics and you show what style you're spinning - which gives you an excellent ace up your sleeve when you can claim that when you play out in parties you mostly spin unreleaed material given by artists, so what comes out then will be a little surprise both for the promoter and the partyfreaks...

Hope you get my point, it is still a saturday morning here so I wouldn't be surprised if I got it all mashed up...

I full agree with Scobbah : for promotional use to show techinque and style you can use released tracks.
Also: if the artist have been selling the track to a label it should not be given to ppl around without talking previously with the label. Matter of respect.

Yes, I think its true that no matter which tracks you use released or unreleased, if you are a good dj, your technique will shine through. However, I have shared a mix of mine that contained all released tracks and gotten the comment "well, your mixing is great, but your tracks are a bit old", but I guess that is the trade off. Not posting the tracklist and making it all one track is another possible option I suppose.

I guess the most important factor to keep in mind would be to always maintain honesty with any labels/artists whose tracks you are considering using.

For a promotional mix I was recording at home, I wouldn't use any unreleased material. However, a few months ago I was in a situation where a set of mine containing unreleased material was recorded without my knowledge. The set did not get out to anyone, and the individual who recorded it had no idea of the label(s) whose tracks were involved. I could have said nothing to the label, and since the chances of that mix ever getting out were virtually nonexistant, nothing would have come of it. However, I was honest about it and informed the label owner of what had happened.

Bottom line: The "unreleased track" dilemma can be a very sticky situation....However I think above all, being honest and straightforward with all artists and labels involved and respecting their wishes in terms of tracks that do belong to them is the most important thing to remember here.

ehehe.. i guess you could. but i think one of the purposes of a DJ mix is to promote the artists as well as the DJ himself. so tracklists are nice to have, imo.

of course the main purpose it to create a piece of music that will take you to places you haven't been before. everything else is secondary.
