...that is the text on the most cds around.
..don't u think the dj breaks the law by playin the record to the public?
..is the djiing "public performance" or not?

Here in Switzerland, party-organisators have to pay for every song which is played at their party... so a DJ has to give the organisers a list of all tracks he plays in his set... everything else is illegal, but noone contols it, at least not in small partys... |

when it come to all djs are criminals, then all artists must be it too, because must psytrance artists uses movie samples and stuff.. and thats illegal right?

i think this is a burocratic stamp in all the cd´s, but i don´t know anybody authorized to play the songs.
The same artist is a "criminal" if he play the tracks before pay the rights. Bizarre world. |

well language, like everything, is imprecise. 
i tend to interpret it this way: if i'm gonna get paid to play (which has never happened, nor will it most likely-i'm a dj 4 fun not 4 profit), then i shuold be buying my tracks.(which i do already-love the BigWigs album btw) and if i'm really hot stuff (like playing b4 hundreds of people-instead of my 3 friends) i should pay the artists when i play their track out too.
but you know, cops and lawyers can only do so much. i think it more important to have parties (even if its technically illegal to dj) to introduce potential customers to your music, than to not have them.
and isnt the real problem file sharing anyway? i think that one has to try and get one's music out there enough to get paid to come and play at a party. that's the only way any artist will make money. and it is about money right? (or are you a cop praecox????  )

i think the language is very precise in this point:)
of course there is some interpretations of it:)
anyway if u are buying the cd - u are not OWNER cause only the OWNER it's AUTHORIZED to pleay this cd for the public (in most cases the woner is the label not the artist:))..
so even the ARTIST can't play (public performance) his music to the public! only if it's unreleased music (he is the OWNER of the unreleased music):)
so... if my interpretation is right:) then ppl who get the profit from UNAUTHORIZED PUBLIC PERFORMANCE (they play the music to the public wchich is not their own) - break the law. also the DJ can't lend the cd to the other DJ cause he is NOT THE OWNER of the music oin the cd! he can lend the cd but only BLANK.
mixing is also unleagal cause it means the UNAUTHORISED person changing OWNER'S music wchich is not allowed.
..anyway we are all psy freaks and the law is for the faggets!

party promoter (club) pay global payment and get permission to play in his club whatever he want, so in legal club parties there is no problem. in unlegal forest or beach party nothing legal, even to make big wigs live its unlegal there.

btw, on of the big label i know - sony music, used to make a compilation a year ago... then CHECKED ALL THE TRAX on the cd and when they found some samples like the speaches from the movie - the asked about the rights. no rights? no track on the compilation:) that's simple!

Unauthorized means exactly this - if you dont have permission from the owner of the track, you cannot play it publically.
A label DJ (for instance), who gets promo material from the label's licensings have that permission. Any other DJ who receives promo material also has it in principal - that is the purpose of promotional material, after all.
However, like said before, if you but the record it doesn't mean you buy the rights to play it publically.
These lines, if you notice, doesn't appear on Vinil releases. Why? because vinils are pressed with the sole purpose of using it to be played. CDs, however, are sold for home use only. clear enough?
so yes, you are a criminal if you want to think like that. but then again, I also drive sometimes above the speed limit - does this make me a criminal? There are many laws that cannot be enforced - the question is: are you moral enough to enforce the morality on yourself without the need of someone to scare you into it (meaning the threat of punishment from the system)?
