today i discovered that someone had the idea of registering www.psygarden.org , while we have been running www.psygarden.be for some time, and have been putting a lot of time and energy into it ...
what do you people think about people "stealing" names this way? is there anything i can do?
i think it's sad... people taking advantage of established names this way just to get known... they don't realise how much we work on these projects... and then this happens...

Trust me rik, this is not the case, it's just a coincidence. No one is trying to benefit from your work. psygarden.org is a website covering the psy trance scene in Serbia.
I understand this is a problem for you... I'm sure some sort of compromise can be made... even if it means changing the name. I will speak to the owners and hopefully it will be resolved without problems.
How am I supposed to hallucinate with all these swirling colors distracting me! |

No there's nothing legal you can do rik. I assume you haven't copyrighted the name "psygarden"? If not there's nothing to do. Heck even my last name which is very unique is being used by another company in USA. And there's nothing I can do about it. So I say live with it.. It's not the end of the world anyway.

Thank you very much for this reply, i didn't want to sound like i'm angry at these people, i just didn't expect this to happen, psygarden is a unique name (except for some japanese garden centre) and this was my intention (instead of just registering goatrance.be or something alike).
if i can work out that they register a different name, i'm even prepared to pay for the costs of their new name. this would be a wonderfull solution!!!!
i posted a message on the forum itself, i hope the admins understand my point of view and are willing to do this!

ok, so far for my belief in the admins being reasonable people. they decided to keep the name after all my offers.

"Stealing domain name" is NOT an appropriate term for this!!!
No one knew that there was some other psygarden, apparently with .be domain. How was anybody supposed to know that there was some other psygarden???? Can you tell me that???
3 gTLDs (generic top level domains) were free: psygarden.org, psygarden.net and psygarden.com. Org domain was chosen and that's it! No one ever wanted to steal something from anybody! |

psygarden.be isn't exactly an unknown site... I've run across it many times, maybe you should respect these guys a little more (especially given the option of a free new domain name for you guys!)... remember, this is a worldwide community where it is respected to be nice!
I went through this same thing nearly 2 years ago... someone in montreal thought it would be cool to start up "ekto plasm records" - co-incidence? seems unlikely but who's to say? We had to yell at each other a lot to reach an agreement as well (which, as it turns out, was facilitated by them having done nothing to further their projects in the meantime)... I guess my lesson there was: never underestimate the power of slack!

I hoped so to... but even with all the offers i made the only reaction i had was "no, sorry. but if you want you can help us with our international section".
Trancemaster: i consider a unique name like psygarden (try google, you'll find pages of links to our website) more than just a combination of words. Even if you didn't know about the existance of our site (which seems unlikely to me, but not impossible) I think i did everything possible to find a solution for both our sites, but obviously this had no effect at all...
Drope: you don't know how long it took me to find a unique and appealing name for our site...
