hello members,

What about cuting samples (vocals) from videos and audio tracks. Ok, very nice if you use in unreleased tracks but if you want to release? Any legal stuff to do?

best wishes

Basically there is a whole process involving your label(if you are signed off course)-CLEARANCE!!!But I say use your own stuff unless you are a remixer or a DJ...There was a story about that VERVE track(blah..blah symphony),well they used a ROLLING STONES sample without clearing it.Later they payed a lot of maney to the STONES!!!

the copyright issue is simple:
if you want to use somebody elses material, call them,
and ask for permission, and if they don't allow it for free, you will pay them some money.

not too difficult ... right ?

boom.

u can get up to 5 seconds from the video / song / whatever.
if you will take more then that then you will have to get the permission for usin it.

Most of the time the sample is just twisted so much you can't figure out the source anyway

Mike A-you are right!!!But again I think it is better to buy a cheap mic, record yourself(vocals)and play with it...it original and believe me it sounds good!!(I recently recorded myself using a cheap mic-10$,and SoundBlaster live and it sounds good after some CLEANIG and some fx!!!!!!!)

Arie -

Sorry mate but I'm sure you're wrong... the law says that if you use any portion of someone else's creation in your own work you must have their permission, whether its 5 seconds or less or completely unrecognisable. In practise it's a good idea to seek clearance if you use something that can be identified in any way. A lot of people don't bother and a lot of people get away with it, but it's your own conscience you're messing with.

Hello Colin. thanx for the correction.
i can add that allot of artists are taking someone else's creation without asking. and the reason that the owners of the original copyright will not procecute trance artists becouse the sales in trance scene are very low and they wont get a bunch of money from procecuting.

I think that taking samles from movies, songs etc.. is not that bad if it was made / produced in a way that shows that something was thought of..

In my album I used the voice of Janis Joplin in the hidden track and on number 6, and I am not sorry at all for doing that coz i believe it came out beautifully and served well the artistic intention of the track.. If I would have to get a singer and hire a studio to do that ... financially it would be too heavy on me,.. instead came out a very special track

I believe that if u USE samples wisely and not ABUSE them and just tuck upon them some sounds of your own and call that a track then it is ok..

Anyway it is better ( and legal ) to ask permission - but the chance to get a permission is very small

One more thing to back up my point of view -

There is a song by Fat Boy Slim - Bird of Pray, in which he uses the voice of Jim Morrison throughout the song. Ofcourse I believe that FBS asked for permission and got it. The thing is that for artists in the trance scene, that sell 3000 copies of an album ( and I went over the hill with this number ) there is no chance whatsoever to get the permission from a major label..

That is the situation..           A man with a "master plan" is often a woman
