I dont understand what you mean with that the law and psytrance is against eachother? Almost every artists i Know or have meet are very aware of the law concerning copyrighs and own the copyright of their own music eighter via registration through national copyright agencies or as in my own case via Publishing agencies!

100% of all labels I have worked with do have the copright to the tracks they release. And believe me many many artists do know what Publishing is... But a lot of the "new-commers" are not being signed to the publishing agencies today due to the problems with sale figures in our scene... We the "old-timers" were more lucky and got signed with Publishing companies because sales was much better back in the "god old days".
So I don't understand your claim. Please enlighten me.

One thing i wanted to ask a long time ago:

most, or all, cd's have saying in the disk itself which reads "Unauthorized copying, public performance, broadcasting, hiring or rental of the recording is prohibited."

Does this mean that as a dj i can be arrested because i'm making a public performance out of the cd (using a track from it in a set)?

chi: this is a complicated issue as i know. there are this professional producer/dj cards, kind of membership, if you own it, its legally. dunno if they can sue you if not...           Anakoluth A Pebble in Your Eardrum's Shoe since 2001!

Fox Broadcasting is again at the center of a trademark dispute. The television company that sued the author of a critical book for using its tagline, "fair and balanced," is being sued for allegedly misappropriating the name of an Atlanta hip-hop band.

On Sunday, Fox debuted a new comedy called "Arrested Development." The band Arrested Development has sued Fox for four counts of trademark infringement in DeKalb County Superior Court. In Thomas v. Twentieth Century Fox, No. 03CV10389-4, the band is asking for an immediate halt to the use of its name, plus damages and attorney fees.

The band filed the complaint against Twentieth Century Fox Film Corp., Fox Broadcasting Co., Imagine Films Entertainment and New World Communications of Atlanta Inc., the owner of the local Fox news affiliate, Fox5 WAGA.

In the complaint, the band calls the name of the new sitcom a "confusingly similar imitation" of the band's name, which is "likely to deceive, confuse and mislead prospective purchasers" of the defendant's products as "authorized by or in some manner associated with the plaintiffs, which they are not."

The complaint alleges that the misappropriation of the plaintiffs' name is causing "irreparable harm" to the band's name and reputation. The band has a federal trademark on its name, according to court filings, but elected to sue Fox in DeKalb under Georgia common law for trademark infringement. Venue is proper, according to the complaint, because one band member's home and the Fox affiliate are located in DeKalb.

In its response, Fox denied the allegations of misappropriation and claimed the band has abandoned its trademarked name.

Arrested Development, the band, was formed in 1989 and reached a national audience with its 1992 album, "3 Years, 5 Months and 2 Days in the Life of..."

The songs "Tennessee" and "Mr. Wendal" from that album became hits, and the band won several MTV Music Awards and Grammy Awards in 1992 and 1993.

The band separated in 1994. VH1 reported in 1999 that the band had regrouped and recently designated the band as one of its "50 Greatest Hip-Hop Artists." In 2000, the band released a new album with another due in 2004.

Although its debut snagged few viewers, the television show has won critical acclaim. Produced and narrated by former "Happy Days" star Ron Howard, the show chronicles a dysfunctional Los Angeles family whose wealthy father has been thrown in jail.

The band's founder, Todd "Speech" Thomas, lives in Fayetteville, Ga., and co-owner Timothy "Headliner" Barnwell lives in Decatur, Ga.

Thomas said in a statement, "Fox has no more right to use 'Arrested Development' for its show than a band would have to name itself after one of Fox's sitcoms."

The band has performed on Fox's local affiliate and has appeared on Fox's former nationally syndicated variety show, "In Living Color." "In Living Color" was the subject of a trademark infringement suit filed by the rock band Living Colour. Fox stopped using a logo similar to that of the band's as a result of that early 1990s suit, according to news reports.

Kilpatrick Stockton attorneys Miles J. Alexander, William H. Brewster, R. Charles Henn Jr. and Lacrecia G. Cade are representing the band Arrested Development.

Henn said the suit was filed on Oct. 16 to get an injunction to stop the show from airing under the band's name on Nov. 2.

However, at an Oct. 26 hearing, Senior Judge James H. Weeks denied the band's request to limit discovery to one week. Instead, the judge ruled discovery would last until Nov. 26.

While shorter than usual, the discovery time limit wasn't short enough to stop the show from airing using the name "Arrested Development." Still, Henn said the case is on a fast track, and he expects to be back in court around Dec. 1.

Defending Fox are Hunton & William's Elizabeth A. Morgan and Amy K. Alcoke. They referred the Fulton County Daily Report to a Fox spokesman in California, who didn't return calls by press time.

Earlier this year, Fox sued author Al Franken over the use of its tagline, "fair and balanced." Franken criticized the network in his book Lies and the Lying Liars Who Tell Them: A Fair and Balanced Look at the Right.

Fox initially sought to force Franken to rename his book. Fox withdrew its complaint after a federal judge refused to block Franken from using the tagline on the cover of his book.

Lets say there is a record label with the name BLUE RECORDS and i want to name my record label BLUE RECORDINGS or BLUE PRODUCTIONS do they have the right to sue me for that?           Toodaloo Motherfuckers!!!!!

DETOX,

It depends if BLUE RECORDS is a trademark name (like sony music). it also depend on the country you are talking about. (from what i understand, trademark and copyright law is not really enforced by the law in easten europe and in asia.)

but Let me give you an example of a case that you probably know: Medium records were forced to change their name to mejium records because apperantly another label was using that name.

hey dudes,
i wanted to ask about advance and other stuff, when i give my track to label how and when i recieve advance money? and what i have to do with that thing that labels asks for? don't remember how it calls...
and what about some kind of registration as an artist?           Without Deviation, Progress Is Not Possible.
