the thing this all comes down to is what happened first:

did any of the artist ever sign a track to a label BEFORE it was on your site under that open license, then the label has a very valid point in asking for the removing of the tracks from your website. because the open license strictly sais that if other licenses apply, the most strict and prohibiting is valid.

If however it was on your website before the labels ever got the tracks, they should have gotten written copies of the license and agreed with the open license conditions. if this never happened, you're also fu*****

one way or the other, i think it's starting to look more and more like the label has a valid point, and you can't sell the tracks without their permission.

I think you got this a bit wrong.
I'm not selling other lables tracks.

I'm basically operating as a web based label, releasing material with permission directly from the artists.

You are absolutley right that there will be a conflict if the tracks was previously realeased on a label or if a label would like to release the music after it has been on the site.

Whatever license terms you use you cannot change the license term for different instances.
You can only have one license on a track, and once it has been released under that license it cannot be released under another license.

So it's a prerequisite for any track to be featured on the site that it has not been released anywhere, unless by someone using the exact same license.
And I make it clear to the artists that although I do not demand exclusivity, in practice it will be pretty much impossible to release the tracks on another label in the future.           (``·.¸(``·.¸(``·.¸¸.·`´)¸.·`´)¸.·`´)

I thought we where discussing the legalities of psyfactory, and I mentioned the tracks from resonantearth that where on there as one example of the different types of legal issues that would concern the ed2k users that host the files.

Sorry but if that is tha case i've wasted far to much time on this thread... for a minute i believed you had a serieus issue here with labels trying to keep you from offering music for a fee/for free.

So why bother pasting private emails and publically discrediting labels just like that?

ps. if an artist ever signs with a copyright organisation, all their future works are protected/managed by them to, so it's impossible for them to later release new tracks under the open license you mention. I hope this didn't happen.

You should maybe have read the thread before you wasted time on it.

I just though you seemed interested in copyright and licensing issues since you kept asking about the legalities of psyfactory, and did say you where interested about open licensing.
