do you think that if in a situation like i found my self looking at a party flayer and there was one of my painting should artists tray to do any thing about it?

I'd certainly contact the organiser about this, it's sad when people that copy artwork for flyers don't even contact the artist to ask for permission to use an image (which they would almost instantly get in my case, even with a high resolution version of whatever image they would want to use).
If the party is a succes I'd ask for some kind of compensation (free entrance at their event, some drinks, maybe even money but this is a delicate issue).
maybe offer your services for their next party and charge your normal fee + some more. I wouldn't threaten people with lawyers because this is something i wouldn't start a trial for (sadly most of the people that shamelessly copy art also assume this)

mutual decision btwn the organiser and designer is the solution.
the designer cant go legal if he hasnt got his artwork protected under IPR.
