-well, i've come up with the following questions, born by a personal experience.
-i made a trakk and sent it to a label as demo, which trakk contains a long female vocal sample (which i found acapella) from a 70's disko hit.
-one friend listened to this trakk and told me the exact following thing: "is this the vocals that the label owner gets to jail or is it a friend of yours singing?"...
-i told him so he noticed to me that this trakk will never be accepted by a label to release only because you must aquire a licence for the vox, which also is too troublesome to be achieved... or else u just get sued.
-now my first question is: 'cause of this sample is from a disko song 25 yrs old, i've already heard the same sample several times by several producers on breakbeat or happyhardcore traxx in the 90'... so did they get a licence (despite the difficulties of 90's, refering on 100% different music cultures, less open-minds, we're talking about a 120bpm disko vocal being boosted to a 165bpm hardcore techno.. et.c) or did they risked their lawful life depending on how much underground was their music at that particular time?
-second question: is only vocal sampling illegal, 'cause almost in every trakk of every elektronik musik kind i listen to every day, i spot at least one sample. or.. (first noticing that Shpongle is one of my favouritestttt groups around, and skillful magicians on composing, sampling and mixing) have Shpongle aquired licences for ALL the samples they have cut and used in their traxx??? (vocal or instrumental)
-am i off topic?
-if yes plz just 'move' this thread, don't 'remove' it, thank you

I think if it was a well known track, then yes, producers might reject it in order to avoid any legal actions from the original production house. but i'm sure that all the tracks produced with oriental or other ethnic samples were never licenced !!

this licenses issue almost never gets too many problems. trance is too underground for them to really worry about if the vocals are from some known track or not, mostly because most samples used in trance tracks, vocals or not, are almost never put as the original, most of the times they get so distorted from the original one, that only someone that really knows where it´s from can notice it. as far as i know, producers do not have licenses for the samples they use, not a rule, but in 95% of the cases, so if big bands should not have problems about it, neither should you

so my advice, do not worry about that

im with lithium, i dont think you have anything to worry about and see these recent examples as proof:
WM- Trancespotting
Eskimo- Voodoo people
X-Noize - Anjuna beach (even within our own scene)

all of these have been released with no legal reprecussions...           "On the other hand, you have different fingers."

thank you both, mates.

i don't worry about the samples i use, i'm just afraid if labels do ... i don't use much anyway; i only use samples for a certain matter that pops in my mind

i know in Portugal one of the most well succeded lables in House music got a fine cause one of their tracks hit the charts big time and it had some sampled voices so they got presocuted.. Although haven't heard anything regarding the trance scene.

sounds logikal mate...
house is a scene that threats charts for years now... so the label got known and probably the cd/vinyl sold too much maybe because of the vocals..
maybe the same would happen if infected mushroom
(which are already well known also to other communities than trance) used a madonna sample without licence in one of their tracks...
