Police brutality over sample copyright theft got me losing sleep!

Will I be locked in a correctional facility reciting mantras like, "Don't drop the soap, dont drop the soap! OHM!", If I route television broadcast up to my computer to record some samples? I am looking for news broadcasts, interesting scientific documantaries or reports. Maybe animal sounds from one of those nature shows. Some of it has to be safe to use. Does anyone have concrete knowledge of what is good, and what is not. Or, have alternatives to acquiring these kind of samples free. I know, this is some serious guerilla manouverinng here, but if you can get it free. If not, Whynot?

dont know about news broadcasts but am pretty sure the BBC and the History channel have documentaries and some interviews.For animal sounds etc, check www.sampleswap.org

Unless it clearly states that´s copyright free...it isn´t.
Some companies are a bit more apreensive about these issues ( some include reverse engineering tech ) others aren´t, when in doubt contact and ask.
It doesn´t mean that you can´t sample whatever you like and use how you will, but if in the future you get hammered with lawsuits about copyright issues you´ll know why.
But as always be reasonable, i don´t think BBC will go after you if you sample a monkey screaming ( i mean a monkey will always sound like a monkey ), but this can change if you sample the background music instead ( even though they first would have to find you, see if they had been harmed by your illegal sampling and if they could profit from the lawsuit ).

as a general thumb rule i think if u use less than 2 mins of anything.. its cool.. more than that u might be running into troubled waters.. n if ur using it to make psy i doubt the histroy channel or BBC will ever fukin find out
it will probably cost them more time n money to file a case against a psy act than wat they will recover from them..

If u use sounds that could come from anywhere, there is no problem (footsteps for example). Sampling voices can be a problem because u can recognise where it came from, and they are hardly ever royalty free... But i never heard of anybody getting slapped with a fee because of voice samples.
The thing to watch out for when u are sampling is not to sample the essence of a song... example: let's take madonnas horrible first single from her new album (and the second single too btw). you have the hook of that song, it's a sample, or maybe a remake from part of an abba song. In the original it was the hook too, so what madonna's producer has done is take the 'essence' of that abba song (the most important part) and build his (frankly very stupid) house song around it... If u do that without paying royalties and without warning the proprietor u will get a lot of trouble... |

Considering the amounts of Psy tracks that use complete samples that are definitely not copyright free, there really is'nt that much of a problem.
Also, the psytrance community has no money - noones gonna bother suing
If your not making psy - then watch out.

tv shows, documentarys and movies (specially if old) won't give you problems... only with ultra-bad luck or if you're a ultra-top producer. but be careful with music. also a label wouldn't release something if it could give trouble. |
