Well a few month's ago a young DJ (that is a regional manager of a label) contact me and asked me for a track for a compilation he is compiling for a new label.
Few month's past and the "Various Artist" CD emerged in the internet psychedelic shops.
Most of the artists on this CD are close friends and it was a nice concept and idia to make a "friendly compilation".
we check whit the label manager and owner and confirmed us that the DJ that contact us is working whit him.
a few month's more have past and the label owner "disappeared from the map" (not answering mails and not answering phone calls)
no contract has been made and no agreement was reached about the music in hand.
the label manager printed the CD and selling it all over the world whiteout paying the artist that made the music and gave him to listen and evaluate.
therefore the label is stealing the artist of there right's and royalties.
who is to be blame ?
is there a "legal" way to solve this issue ?
and if so... what is the process if the label is not in your country ?
did any of you artist's has encountered similar acts agents our hard work ?

Weeell, you could ask for a moderator to move this into the "trance" section of the forum, then give the name of the dj and label to the public so that 20 people will jump in takin one side or the other and all the rest of us wil have 10 pages of dogfights to read while getting bored to death at work
Don't mean to be bad or anything like that, sounds like a shitty situation but that seems to be the "dish of the day" for isratrance lately, maybe we should have a new forum category labeled "label black list" or something...
Cheers!

well, you didn't make a contract... Where's the proof that you gave him the song, that the song is yours... And even if there is proof, if the label is in another country than yours, it will be very dificult in court.
I'm from Portugal and if I did that here, the whole case would be archived because the legal system is very slow here. I got cought with a little hash and I only went to court after a year and a half... In canada it takes about 3 days..
I don't think anybody here on isratrance can legally help you. The best thing for you to do is to present your case to a lawyer. Than he will tell if you should go on with it or not.
But we can always "run down" the label and the owner.. and don't worry that cd probably has more downloads than 10 times the sold cd's
You can also do as Tom Cosm and distribute all your music free.. Its a good aproach for getting knowed..
I wish you luck Super Banana Sauce http://www.soundcloud.com/knocz |

Thats why we in holland have an organisation called buma/stemra
You can register all your music there so you can prove that you are the legal owner and creator of the tracks
Also you get money when people use your tracks/play em (all clubs have to pay loads of money to be able to play music to a big crowd, that money is devided over the artists that are member)
Anyway, i believe there are companys like this for almost every country
Lookit up somewhere and register your tracks there so the next time this happens you have some legal proof + support
Ciao!

In the uk to copyright a song or a track you just have to send it to yourself by the post, and keep the sealed envellope. this is enough proof..... but it is differrent from place to place. in any case it shouldn't be difficult for you to prove its your creation.
I think the best thing to do here is to evaluate the situation and see if its worthed to engage a legal battle.
in other words, did he made enough money with your piece to justify the time and money you gonna spend solving this case.
you also have to consider the possibility that he might not have much money left anyway and if he cannot pay then all this might be useless.
in the future before you give a full copy of your track you should make sure the people you dealing with are serious.

Hey man, it's a shame that you have to take your precious time dealing with these bastards. If I were you I would rip the entire CD, compress it into flac or mp3 and upload it somewhere and place the download link at every psy forum you can find.
It's not legal but who will sue you then, when those guys dissappeared?

i can prove that the music is mine.
i have the original track in 32 bit (in unmaster version , original EXPORT) and the original files that i have build it (the "save" from the program im composing whit).

well, many label are ot even registered as a company... i mean they all they do is black market.. because if they were registered, the laws will force them to sign contracts with their artists and of course they will need official "Invoice" to prove what they have done with the money.
So, how can you sue a label that doesn't even official exist ?
And aother thing...is it really worth to sue a label for only 150 -200 Euro \ track?
  NEW ALBUM OUT SOON !!!

I think that you won't get much money either... But if your wan't personal revenge, if the state knows that he made illegal money and a fake buisness he can be charged for fraud. Mostly the state gets the money and he will be in debt for the rest of his life.. I wouldn't go that way..
Learn from this experience..

That's the worst thing I've ever heard. Would you mind elaborating on that. Maybe warn others of the pitfalls. |
