I have had a little thing bothering me for a while now. A “fellow” Deviant designer from Mexico (as I) has been creating commercial designs very similar to designs I have made. I´m not really sure which category this falls into: copy, plagiarism, imitation, breach of copyright, Fan Art or just plain creative theft. This has been going on for several years now. The first time it happened I laughed a bit and actually thought it was flattering. Second time it happened, it started to bother me. I actually confronted him a long time ago and he apologized so it was cool. You could say I´m a bit of a pacifist. Even after this confrontation which was more positive than aggressive, this did not stop.

I have put up some of the examples I could get my hands on (even though there are more, I couldn´t find). I created the first one for a big festival in Japan (1A), the second was for Brazil (2A), and the third was for a party I threw (3A). The designs on the right are created for Mexico by Cuca (Deviant Link – [link]) and his company Ismerai Design. Link-- [link] .
The “similarities” of the first two pretty much speak for themselves while the third one is more subtle ( I think even the font is the same). The thing that surprises me is that a lot of work and time was put into these copies. Instead of wasting that much time copying something… why not try making something form scratch?? I´m sure it would be easier. Is this what creativity boils down to? There is an old quote (I can´t remember who said it though) – “creativity lies in how well you can hide your plagiarism” Screw that, I really disagree with this statement. I think there is a huge quantity of art and design out there and sometimes it´s hard for something not to resemble something else. This has to do with styles, trends, perceptual limitations, and maybe even collective consciousness. But even though this being true… NEW and ORIGINAL art and design is created every day. This is called creativity and a trait of the human species. Postmodernism is a joke and the boundaries of art in general are constantly being pushed further and further. Deviant Art is the perfect example to see how art evolves every single day on a global scale.

I recently read an article in Computer Arts about a very similar case. The designer in question had been copied several times. He stated in the article that at first he was angry and later calmed down and decided to get the most out of the situation, and used this to create even better designs. Ok, I agree with this. But it is not an excuse for copying designs; especially commercial designs. When you SELL design, you sell ORIGINAL design. At least that´s what your clients think. For example 1A and 1B I actually contacted the organizer of the party asking him who designed it and showed him the original. The promoter had no idea the design was stolen. I asked Cuca if he made it and he denied it. When I asked the promoter, he confirmed that he had commissioned the design to Cuca and Ismerai.

Now Mexico is a big place, and the Electronic Music scene is big, but if you´re up to date, you know what´s going on pretty much all over the place. It was inevitable for me to see these designs because we work in the same scene. People actually send me his designs saying- “look at this copy hahahaha”. I really do not understand this. This guy knows how to use P-shop. Why copy and sell designs in an environment where you´re bound to be caught or at least questioned, confronted, and burned? Is there no respect for the time and effort one puts into a design or art piece??

I didn´t really want to do this, but many friends and fellow designers convinced me it was necessary for this to be exposed. I did not post this to cause trouble but I do think it´s important for people to know about this for one simple reason: If this is happening to me, it could be happening to other Deviants as well. I love Deviant Art because it´s a great source for inspiration, but I do not think it´s a place to come rob. Another reason is because even though it makes me push my own creative boundaries, it pisses me off that he´s charging money for these designs. I think this is highly unethical and just plain wrong when you call yourself a creative professional. The third reason is because I would really appreciate to hear the opinions of other Deviants on this subject.

yeah well its quite sad really that Cuca thinks he can get away with this without being caught. Pure ignorance. It really upsets me to see this in mexico although im not really suprised on this type of behavior in the mexican trance scene. Between fake parties, unpaid gigs, mafia run organisations and theiving design artists.... what more can be said. All those who put their energy to make something better goes to waist by an idiot of some kind who has no originality or talent. Just sees the side of money.

This kind of comments just give a bad image to Mexico. It doesn't happen only in Mexican Trance Scene, I can say it happens all over the world; so in my opinion is better to work with professional organizers and designers and not only with junkie irresponsible kids

Unfortunately... Your work is not the only one that this dude whose promotes himself as one of the best graphic designers in Mexico (GLUP!!) uses for his benefit....

He "works" for Gmartell Music College, all the stuff he mades there are plain ripoffs of other ppl work

Few examples:

Using photos of deco made for International Music Festivals for his stage design classes (how does he even dare to teach?!?!)

GMix 02 (an annual student compilation) cover art was sampled from the old 3Dvision covers made by Sub88...

do you have any explication about it?
i dont had any freaky idea if ismerai's people drops any line in this forum every now and then but lets sit and watch what is next.....
