The person who copyrights the name, owns it. Simple. However, it also depends on the country.

You have to copyright it in every country you want to own the name in.
And yes, some labels don't notice, trance is too small and does not really count. And anyway, the money they can make from suing a trance artist/label is less than what they're lawyer takes for an hour.
There were cases of people changing names because of copyright. Last one being Medium changing to Midijum.
