illegal use of samples?

it's not a problem, as long as u don't sample the essence of the song... example: in hiphop a lot of the time they use entire loops out of a song on top of the beat/bass. For that u have to pay royalties to the owners of the original. But if u just lift one snare out of a song nobody can ask royalties. At least, that's the theory... In practice it doesn't happen a lot... in the early days of hiphop there were lot's of lawsuits for this, but these days it seems that nobody cares anymore...
And ofcourse i'm ok with it to use samples from sample cd's if u use it in an original way (i can't hear they come of a sample cd if u do that anyway )... But what i don't like is artists who just pile up a drumloop from one cd on a bassline from the other, with some fx from a third cd and then a lead that he made himself... That's not the way to go imho... Also, there are some very popular sample-cd's and i keep on hearing the same samples from those cd's over and over.... Like that 'scary' sample i first heard in max payne, afterwards in lot's of asiatic thrillers, horror movies, etc... i even heard it in 2 or 3 psy songs... Maybe i'll put it online once, everybody will instantly recognise it because it's so overused... And it hardly ever gets edited, it's just always thrown in there dry off the cd... I just can't bring myself to respect things like that... That's taking the easy way out when u can't make something urself... Like using presets from synthesizers instead of looking for the sound u really want...
I have to admit that u guys are making me doubt my convictions maybe i am brainwashed by extremist hiphoppers (where using a downloaded sample is already a deadly sin, and using a sample cd sample is suicide)... |
