"(a) Any person who conducts a public event at night that
includes prerecorded music and lasts more than three and one-half
hours is guilty of a misdemeanor punishable by a fine of ten thousand
dollars ($10,000) or twice the actual or estimated gross receipts
for the event, whichever is greater."

What a stupidly broad bill. A digital synth that uses wavetables arguably counts as "prerecorded music"

ok so when a party gets shut down for violating the above then we are legally allowed to get totally wasted on hamms have and fire semi automatic weapons full of blanks at the moon trying to "pick off god" while having awkward guilt ridden sex with copies of the constitution... and that is somehow less offensive than an event at night which includes prerecorded music and lasts more than three and one-half
hours?

I may be wrong, but it seems that the key word here is "public". As in "a block party", for example. Have your parties on private property and this bill won't apply to you. Just like you cannot drink openly on the street but can do it at home (or even anywhere out of a brown bag ).

"public" does not mean "on public property", it means "open to the public" = anyone is allowed to come.

Yeah, I see they thought of my trick already - one would have to have a license to throw a party on his private property. Which is pretty strange: this law does not eliminate "raves" - it just pushes them into clubs.

I wonder, can't you make each DJ set a separate "event" and have a bunch of 2-hour "events" instead of one long "rave"?

(b) Subdivision (a) shall not apply to a public event on private
property if the entity that conducts the public event has a business
license to operate a bar, club, theater, entertainment venue, or
other similar business, or to conduct sporting events, and conducting
the public event is consistent with the business license.

So just use a private LEGAL venue. I don't know what the big f'in deal is.

Licensing is a problem.
You cannot just throw a party on your farm - has to be a club. Other than that - no problem.

Anyway, if you want an overnight party, you just have to pretend that each DJ is an organizer and each one of them has a separate event. You just happened to have your events back to back in the same place.
As long as none of the sets is longer than 3.5 hours...
Come think of it - they are passing this law with the sole purpose of banishing Goa Gil.

You can make a private party with "donations" on your farm, no problem!
America is so backwards when it comes to that kind of thing. Not that most of the rest of the world is much better, India was always cool, pay the police, then pay them again when they show up at the party and no worries guaranteed!

This bill is fall out from several series of high profile overdoses at large raves in SF & LA.
One event in particular just south of SF at the Cow Palace (which is in the district of the Senator that sponsored this bill) had 7 in one night.

This bill as it is written is quite unconstitutional. While none of us want to see it passed, after several years of lawsuits, it will find it way to the 9th circuit court, which will most likely strike it down.

BUT
I urge all Californians to write their state senator and state assembly person.
Some good talking points to bring up, are the above mentioned likely hood of the bill being struck down. No politician likes their name attached to a rather public bill that fails.
Additionally a good point to bring up (especially in the current economy) is the jobs that will be lost by this bill passing.
How many sound engineers, lighting techs or the like will be put out of work? Giving the current economic forecast many politicos want to stay as far away from anything that might put more Americans on the government well fare tit. Play that angle up to our benefit.

That blows...this is one of the first times i'd have to say I'm glad i don't live in California anymore. Viva La Outdooooorz.

one of the underlying things that this bill really calls attention to is the overwhelming need for education. The events that have brought this bill life are those that are catered more toward younger, inexperienced partygoers, that tend to lack the guidance of the older, more experienced generations. A majority of a reason why the older generation isn't present at these types of events are obvious, but still does not diminish the need to educate those new to the scene or that act irresponsibly. For sure there will always be one bad egg, but if you can keep a majority of the people aware of the consequences for their actions, then we can at least hopefully keep the incident tally a lot lower.

While incidents like that are at least a bit more rare in our circle of friends, we still need to stay vigilant and take care of our family members. If you see someone having some difficult, if you are not able to help, let someone know who can actually help the situation. An oz of prevention is worth a lb of cure.           An Eagle may soar, but Weasels don't get sucked into jet engines.
